Setback Variance <br />FILE NO: 758.09 - 94. <br />BACKGROUND <br />Northern Air Corporation has applied for a variance from the rear <br />yard setback to permit the expansion of leased space in their <br />building. The proposed expansion would encroach to within two or <br />Three feet of the property line. The property is located at 75 S. <br />Owasso Boulevard and is zoned I -P, Industrial Park District. The <br />I -P District requires a rear yard setback of twenty feet. <br />ANALYSIS <br />The Little Canada Zoning Ordinance sets out five criteria for the <br />consideration of variance applications. Each of the criteria are <br />to be met in order to give the City the discretion to approve a <br />variance from the performance standards. The five criteria are <br />listed below: <br />a. Special conditions (such as topographic conditions of <br />narrowness of an existing lot) which are unique to the <br />property in the zoning district. Special conditions may not <br />be economic in nature. <br />b. The Ordinance provisions would deprive the applicant of rights <br />enjoyed by others in the district. <br />c. Special conditions are not the result of the actions of the <br />applicant. <br />d.
