ISSUES & ANALYSIS <br />Conditional Use Permit. Section 903.020 F. 9. of the Little Canada <br />City Code allows for special purpose fences, such as the one <br />proposed, to exceed the typical height requirement for fences in <br />any zoning district. This section of the code reads as follows: <br />"Fences for special purposes and fences differing in construction, <br />height or length may be permitted in any district in the City by <br />issuance of a conditional use permit ". <br />The proposed fences are considered special purpose fences, due to <br />their height (City Code requires a maximum of 8 foot tall fences), <br />and purpose of the fences, which is to provide a safer environment <br />for students and residents of the adjacent residential area. <br />Section 903.010 requires the City to consider the following factors <br />when reviewing all conditional use permit requests: <br />1. The proposed action has been considered in relation to the <br />specific policies and provisions of and has been found to be <br />consistent with the official City Comprehensive Land Use Plan. <br />2. The proposed site is or will be compatible with the present <br />and future land uses of the area. <br />3. The proposed use conforms with all performance standards <br />contained herein. <br />4. The proposed use will not tend to or actually depreciate the <br />area in which it is proposed. <br />5. The proposed use can be accommodated with existing public <br />services and will not overburden the City's-service capacity. <br />The proposal to construct a 10 foot high fence along soccer fields, <br />and a 15 foot high fence along the new tennis courts will not have <br />an adverse effect on any of the above factors. <br />Location. All fences must be located entirely upon the property of <br />the of the fence owner, and a boundary line fence cannot be erected <br />closer than three (3) feet to an existing parallel boundary line <br />fence. <br />Construction and Maintenance. Every fence shall be constructed in <br />a substantial, workmanlike manner and of material reasonably suited <br />for the purpose for which the fence is proposed to be used. Every <br />fence shall be maintained in such condition as to not become a <br />hazard, eyesore or public or private nuisance. Link fences, shall <br />be constructed in such a manner that no barbed ends shall be at the <br />top. <br />2 <br />Page 147 <br />
