DEVELOPMENT CONTRACT <br />AGREEMENT, dated , 1994, by and between the CITY OF <br />LITTLE CANADA, a Minnesota municipal corporation, ( "City ") and James A. <br />Olson and Christine M. Olson, husband and wife, and Thomas Theis and <br />Annette Theis, husband and wife, ( "Developers "). <br />1. Request for Improvement. The Developers have requested the City <br />to allow the construction of the extensions of sanitary sewer, storm sewer, <br />water main, curb and gutter, and bituminous roadways to serve the simple <br />subdivision, which is an extension of Leeward Way as shown on Exhibit A. <br />These public improvements will serve Tracts B and C of the proposed <br />subdivision of the following described property: <br />The west 282.93 feet of the south 85.71 feet of the north 1228.82 feet <br />of Lot 13, Auditor's Subdivision No. 43, County of Ramsey, State of <br />Minnesota. <br />The improvement is necessary to provide access and utilities to the <br />proposed residential subdivision as shown on Exhibit A. <br />2. Conditions of Approval. The City hereby approves the subdivision <br />pursuant to City Council Resolution No. 94 -5 -127 and further conditioned <br />upon the Developers entering into this Agreement and guaranteeing <br />compliance with terms therein. <br />3. Compliance with Laws and Regulations. The Developers represent <br />to the City that to the best of their knowledge the extension of the public <br />improvements to this subdivision will comply with all City, County, <br />Metropolitan, State and Federal laws and regulations, including, but not <br />limited to, subdivision ordinances, zoning ordinances, and environmental <br />regulations. The Developers shall pay all necessary permit fees for the <br />project including, but not limited to, the permit required by the Minnesota <br />Department of Health due to the water main extension, the permit required <br />from the Minnesota Pollution Control Agency for the sanitary sewer main <br />-1- <br />Page 152 <br />
