street, drainage, and utility right -of -way for the extension of Leeward Way <br />as indicated on the proposed subdivision diagram and will also dedicate <br />six -foot utility and drainage easements around the perimeter of Tracts A, <br />B, and C in the proposed subdivision. <br />7. Consents to Easements. The Developers shall obtain consents to <br />any required easements as necessary. <br />8. License. The Developers hereby grant the City, its agents and <br />employees, a license to enter any of the above - described property to <br />perform all necessary work, maintenance and /or inspections deemed <br />appropriate by the City during the construction of the improvements. The <br />license shall expire after the improvements are installed pursuant to this <br />Agreement and accepted by the City. <br />9. Responsibility for Costs. The Developers shall pay all costs in <br />conjunction with evaluation, design and construction of the improvements <br />and all costs incurred by the City relating to the preparation of this <br />Agreement, and all reasonable costs and expenses incurred by the City in <br />monitoring and inspecting the construction of the improvements and all <br />costs relating to the construction of these improvements and acquisition of <br />easements, but not limited to, attorneys' fees, engineering costs, <br />appraisals, City staff time, planning costs, and administrative fees. It <br />is also understood that the Developers shall reimburse the City for any and <br />all costs associated with the review of the subdivision approval. <br />Simultaneous with the execution of this Development Agreement, the <br />Developers agree to deposit the sum of One Thousand and No /100 Dollars <br />($1,000.00) with the City as deposit towards costs to be incurred. The <br />funds deposited with the City shall be applied towards the payment of costs <br />incurred by the City as set forth above. To the extent that the funds <br />deposited are insufficient to satisfy the costs incurred by the City, any <br />additional costs shall be paid within five (5) days of billing by the <br />-3- <br />Page 154 <br />
