mutually acceptable credit factor to modify provisions 4.1.3.6. and <br />4.1.3.c. <br />4.1.4. Compensation to the Engineer for basic services performed for <br />projects of less than $100,000 shall be paid on an hourly basis plus <br />reimbursable expenses in accordance with Schedule "B ". <br />4.2. Payment for Additional Services <br />4.2.1. The City shall pay the Consultant for Additional Services of the <br />Consultant performed under SECTION 2, "ADDITIONAL SERVICES ". <br />4.2.2. For all services described under SECTION 2 of this Agreement, the <br />City shall pay the Consultant in accordance with the attached Schedule "B ". <br />4.2.3. The City will pay the Consultant for the cost of Reimbursable <br />Expense as defined in SECTION 2, on the basis of the Consultant's <br />documented costs. <br />4.2.4. For preparation of record plans on projects of $100,000 or greater, <br />the City will pay the Consultant the lesser of the actual time spent on <br />this work as per the rates shown on Schedule "B" attached hereto or a fee <br />equal to one -half percent of the completed construction cost. For projects <br />whose construction costs are less than $100,000, the City shall reimburse <br />the Engineer based on actual time spent pursuant to Schedule "B ". <br />4.2.5. For other extra services not herein provided for, the City shall <br />pay the Consultant in accordance with the attached Schedule "8". <br />4.2.6. No deductions shall be made from the Consultant's compensation on <br />account of penalty, liquidated damages, or other sums withheld from payment <br />to contractors. <br />4.2.7. If any work performed by the Consultant is abandoned by the <br />contractor or suspended in whole or in part by the City, the Consultant <br />shall be paid for costs and services performed prior to receipt of written <br />notice from the City of such abandonment or suspension. The Consultant <br />shall also be paid for any terminal expenses resulting therefrom in <br />-15- <br />Page 180 <br />
