accordance with the attached Schedule "B ". <br />4.2.8. The following compensation procedure will be utilized for projects <br />built directly by developers or their contractors, where the City is not <br />party to the construction contract. Compensation for all phases shall be <br />based upon actual time spent at the rates shown on Schedule "B" attached <br />multiplied by 1.3 plus all direct costs. Estimates of cost for each phase <br />of the work shall be provided when requested. <br />4.2.9. All properly documented and authorized payments due from the City <br />to the Consultant shall be made within 30 days of the receipt of the City <br />of the Consultant's statement therefore. <br />SECTION 5. GENERAL PROVISIONS <br />5.1. The Consultant shall act as the City's agent only as provided for <br />within this Agreement. The parties agree that all engineering services <br />provided by the Consultant under this Agreement shall be of the expected <br />standards of the Engineering Profession and that all employees of the <br />Consultant assigned to the various phases of work on this Project shall be <br />experienced and qualified for the work to be done. <br />5.2. It is understood that the Consultant's assignment of on -going <br />personnel to the City's account is a vital consideration relating to the <br />retention of the Consultant. Therefore, the Consultant shall endeavor to <br />maintain said personnel assignment so long as reasonably practical for the <br />duration of this Agreement. No change in the assignment of the designated <br />"City Engineer" shall be made by the Consultant without the expressed <br />consent of the City. However, should the City not be satisfied with the <br />current personnel assignment, it may request the Consultant to re- assign <br />personnel to its account subject to final approval by the City. Should a <br />change in personnel result from whatever reason, the hourly rate for the <br />newly assigned person shall be the lesser of the newly assigned person's <br />-16- <br />Page 181 <br />
