Hanson, City Administrator <br />RE: Dianna Lane Retaining Wall <br />MAYOR <br />Raymond G. Hanson <br />COUNCIL <br />Beverly Scalze <br />Jim LaValle <br />Steve Morelan <br />Bob Pedersen <br />ADMINISTRATOR <br />Joel R. Hanson <br />Mr. Jagadish Desai has contacted the City regarding maintenance <br />and upkeep of the retaining walls in the Dianna Lane area. After <br />researching the retaining wall issue, I informed Mr. Desai that <br />the City never accepted the retaining walls, and these walls are <br />the responsibility of the homeowners' association. The Council <br />may need to state its position in this regard upon further advice <br />of the City Attorney. <br />Mr. Desai disagrees with my position and feels that when Dianna <br />Lane was accepted by the City on August 13, 1980, the retaining <br />walls were also accepted as part of that action. (See Minutes <br />Attached.) <br />A solution to this matter may be the City undertaking an <br />improvement to either construct adequate retaining walls or <br />eliminate them and regrade the area. Either option could be <br />financed by an assessment to the homeowners' association, subject <br />to receipt of waivers of right to appeal from affected property <br />owners. <br />I would ask the Council for some policy direction as to how to <br />proceed. Should the Council feel a City improvement would be <br />warranted, a neighborhood meeting would be in order to discuss <br />the matter in greater detail with the affected property owners. <br />cc: Jagadish Desai <br />Page 13 <br />
