Text Amendment The Little Canada Zoning Ordinance must be amended <br />to include "light" auto body repair in the definition of "Minor <br />Auto Repair ". As mentioned, the current uses allowed under minor <br />auto repair include tire and battery change, oil change, or muffler <br />shops. The following proposed text amendment allows the ABRA Auto <br />Body to operate as a conditionally permitted use in the B -3 zoning <br />district: <br />8. Automobile Repair - Minor. Minor repair shops including <br />light auto body repair, tire and battery change, oil <br />change, muffler shops for passenger automobiles and light <br />trucks not to exceed twelve thousand (12,000) pound gross <br />weight. <br />Conditional Use Permit. Section 921.010 (C) of the Municipal Code <br />requires the City to consider possible adverse affects of the <br />proposal. Its judgement shall be based upon but not limited to the <br />following factors: <br />1. The proposed action has been considered in relation to the <br />specific policies and provisions of and has been found to be <br />consistent with the official City Comprehensive Land Use Plan. <br />2. The proposed site is or will be compatible with the present <br />and future land uses of the area. <br />3. The proposed use conforms with all performance standards <br />contained herein. <br />4. The proposed use will not tend to or actually depreciate the <br />area in which it is proposed. <br />5. The proposed use can be accommodated with existing public <br />services and will not overburden the City's service capacity. <br />Zoning. The subject site is zoned B -3, General Business District, <br />which, under the new definition of Minor Automobile Repair, would <br />allow an ABRA Auto Body as a conditionally permitted use. <br />Therefore, the proposed use is an acceptable use of the property <br />under certain conditions found necessary by the City of Little <br />Canada. <br />Comprehensive Plan Consistency. With the zoning text amendment, <br />the proposed use would be a conditionally permitted use within the <br />City Zoning Ordinance. The proposal is consistent with the <br />policies outlined for the Rice Street Business District as follows: <br />o Establish the Rice Street Business District as the primary <br />retail and service focal point of the community and promote <br />and facilitate through direct public involvement further <br />complementary development in this area. <br />Page 26 <br />
