The <br />request which ABRA is making is to be considered as a use which is <br />included with the uses allowed under the "Auto Repair - Minor" <br />classification. Such uses include Tire and Battery shops, Muffler <br />shops, and Tune -up and Oil change shops, all of which may be <br />allowed by Conditional Use Permit. ABRA makes the argument that <br />their operation is less noisy or noxious than some of these same <br />uses, and that an ABRA operation would not be detrimental to the <br />Rice Street area. The issue for the City is whether the text <br />amendment would permit other auto body uses into the commercial <br />areas which do not adhere to the same standards which ABRA has <br />stated that it will. <br />The standards imposed by the Minor Auto Repair CUP process are <br />listed in Section 911.040.0 of the B -2 District. These standards <br />include requirements for building materials, landscaping, paving, <br />lighting, signing, and parking, among others. Also included is a <br />section which would allow outdoor storage, subject to a screening <br />requirement. One response to the ABRA proposal would be to <br />eliminate this allowance in the Minor Auto Repair section. <br />Presumably, any outdoor storage related to automobile service uses <br />in the Rice Street area would be objectionable. <br />It should <br />reasonable <br />are deemed <br />Use Permit <br />within the <br />sufficient <br />also be noted that the City has the right to impose <br />additional requirements on Conditional Uses where they <br />necessary.
