Any fence which endangers the public safety, health <br />or welfare shall be considered a public nuisance and abatement <br />proceedings may be instituted by the proper City Official if within <br />15 days after notification the owner of such fence has not <br />undertaken the necessary repairs to himself abate the nuisance. <br />Link fences, shall be constructed in such a manner that no barbed <br />ends shall be at the top." <br />The proposed rebar fence is susceptible to rusting, and the <br />temporary nature of the construction may result in a nuisance <br />problem or be unsightly. <br />Building Permit. All fences proposed for construction within the <br />City of Little Canada must first obtain a building permit. <br />RECOMMENDATION <br />Due to the temporary nature of the fence our office recommends <br />denial of the conditional use permit as proposed. However, we <br />would recommend approval of construction of a permanent fence <br />subject to the following conditions: <br />1. The existing fence be removed from the property. <br />2. The proposed fences may not be closer than three (3) feet to <br />any existing parallel boundary line fence. <br />3. The fence must be constructed in a substantial, workmanlike <br />manner and of material reasonably suited for the purpose for <br />which the fence is proposed to be used, and maintained in such <br />condition as to not become a hazard, eyesore or public or <br />private nuisance. The fence may not be constructed in such a <br />manner that the barbed ends are located at the top. <br />4.
