3. The proposed use conforms with all performance standards <br />contained herein. <br />4. The proposed use will not tend to or actually depreciate the <br />area in which it is proposed. <br />5. The proposed use can be accommodated with existing public <br />services and will not overburden the City's service capacity. <br />Conditional Use Permit. Section 903.020 F. 9. of the Little Canada <br />City Code defines a special purpose fence as follows: "Fences for <br />special purposes and fences differing in construction, height or <br />length may be permitted in any district in the City by issuance of <br />a conditional use permit ". <br />The proposed fence may be defined as a special purpose fence due to <br />its unique construction. The fence is constructed of a wire mesh <br />with a grid of 2 inches by 3 inches. It is 2 feet high and <br />supported by 3/8 inch diameter rebar sections 5 feet in length. <br />The rebar sections are placed through the wire mesh grid and driven <br />approximately 3 feet into the ground. The rebar sections are <br />spaced at 6 to 12 foot intervals to support the wire mesh along the <br />contour of the ground. The rebar stakes are to be fitted with 1/2 <br />inch copper plumbing T's to prevent accidental impalement. <br />However, the spirit and intent of allowing a special purpose fence <br />is to provide for permanent fences which exceed height requirements <br />such as the fences which surround the tennis courts and soccer <br />fields at the Roseville Middle School, or a special purpose fence <br />may be an ornamental fence or heavy duty security fence. <br />The proposed is a temporary fence, to be taken down before the <br />ground freezes this fall, and would be reinstalled again in April <br />1995. The fence is constructed of rebar pipes, which is <br />susceptible to rusting, with wire mesh strung through it. This <br />type of fencing is similar to that which people use to keep animals <br />out of their gardens. Due to the temporary nature of the fence, <br />the City may wish to consider requiring the applicant to construct <br />a permanent, more ornamental fence. <br />Location. All fences must be located entirely upon the property of <br />the of the fence owner, and a boundary line fence cannot be erected <br />.closer than three (3) feet to an existing parallel boundary line <br />fence. The fence is located entirely upon the subject property and <br />meets the applicable setback. <br />Construction and Maintenance. Section 903.020 F.4. of the City <br />Code states: "Every fence shall be constructed in a substantial, <br />workmanlike manner and of material reasonably suited for the <br />purpose for which the fence is proposed to be used. Every fence <br />shall be maintained in such condition as to not become a hazard, <br />eyesore or public or private nuisance. All fences shall be so <br />2 <br />Page 88 <br />
