City Council <br />August 12, 1981 <br />Vacation Of <br />Portion Of <br />Bluwood <br />Avenue <br />V RESOLUTION NO. 81 -8 -399 - APPROVING THE CONDITIONAL USE <br />PERMIT FOR SIGNS FOR CONNCO SHOES AND FURNITURE SHOWCASE <br />TO ALLOW THE PRESENT ROOF SIGN AND THE FURNITURE SHOWCASE <br />SIGN ON THE NORTH SIDE OF THE BUILDING AND THE TWO SIGNS <br />LOCATED ON THE FRONT OF THE BUILDING FOR FURNITURE SHOW- <br />CASE AND CONNCO SHOES WITH THE UNDERSTANDING THAT NO <br />FURTHER PERMANENT SIGNS OR TEMPORARY SIGNS OF ANY NATURE, <br />INCLUDING BLINKING TYPE SIGNS, BE ALLOWED ON THE BUILDING <br />The foregoing resolution was duly seconded by hrs. Scalze. <br />Ayes (5) Fahey, Scalze, Hanson, Nardini, Forsberg. <br />Nayes (0). <br />Resolution declared adopted. <br />This resolution appears In Resolution Book No. 7, Pages 270 and 271. <br />Mr. Forsberg commented that he did not approve of the situation <br />where a business erected their permanent signs under a temporary <br />sign permit. The City Planner commented that the City staff has <br />the authority to issue temporary sign permits, and it was a chance <br />the business took in erecting their permanent signs under this <br />permit. Had the signs not been approved, the City has the authority <br />to require removal of these signs. <br />Mayor Hanson opened the public hearing on the proposed vacation of <br />the north ten feet and south ten feet of Bluwood right -of -way, <br />also known as Central Avenue, and maintain a utility easement on <br />the south side of Bluwood Avenue. <br />Mayor Hanson stated that the reason Council initiated this action <br />was that Mrs. Schabert previously requested approval of a property <br />division. One of the lots that would result from the division would <br />be a corner lot and did not meet the 11,000 square feet requirement <br />of City Code. The lot would only consist of 10,800 square feet. <br />If the proposed vacation were approved, it would give the Schabert <br />property enough area to meet the 11,000 square foot requirement. <br />Mr. Mark Lendway, a resident on Bluwood Avenue, appeared before <br />the Council. Mr. Lendway stated that he was not in favor of the <br />vacation of this portion of Bluwood. The vacation would just give <br />him more property that would be of no use to him and would increase <br />his property taxes. Mr. Lendway stated that he was in favor of <br />Mrs. Schabert being granted a variance so that she could divide her <br />property. <br />Councilman Fahey stated that if the Council did any vacating on <br />Bluwood Avenue it should vacate the property down to only what is <br />needed for Bluwood. Fahey stated that it does not make sense for <br />the City to maintain a 100 foot right -of -way for Bluwood. <br />Mayor Hanson stated that he agreed with this, but also felt that at <br />the present time Mrs. Schabert should just be granted a variance and <br />Council could consider the vacation at another time. <br />Page 11 <br />
