MINUTES <br />City Council <br />August 12, 1981 <br />Schabert <br />Property <br />Division <br />Mr. Lendway pointed out that when the homes on Bluwood were built <br />there was the 100 foot right -of -way and the homes had to be built <br />30 feet back from that right -of -way. Any property gained by the <br />vacation of Bluwood would only add to the front yards, and would <br />be of no use. There would also be utility easements across that <br />property. <br />Mrs. Scalze suggested that the vacation only apply to the Schabert <br />property, and Council can consider the further vacation of Bluwood <br />at another time. Scalze also pointed out that the requirement <br />of 11,000 square feet on a corner lot has given the City a lot of <br />problems. Scalze stated that the lot size was to provide that <br />setbacks could be met for safety reasons. As long as those setbacks <br />could be met with less than the 11,000 square feet, Scalze felt <br />that was accomplishing what the City wanted. <br />Mrs. Scalze introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 81 -8 -1100 - CLOSING THE PUBLIC HEARING ON <br />THE VACATION OF A CERTAIN PORTION OF BLUWOOD AVENUE <br />The foregoing resolution was duly seconded by Mrs. Nardini, <br />Ayes (5) Scalze, Nardini, Hanson, Forsberg, Fahey. <br />Nayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 7, Page 271. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 81- 8 -401 - VACATING 10 FEET OF BLUWOOD <br />AVENUE DIRECTLY ADJACENT TO LOTS 1 AND 2, BLOCK 4, J. <br />F. EISENMENGER'S FOURTH ADDITION WHICH WOULD BE ONLY <br />FOR THE PROPERTY OWNED BI MRS, SCHABERT ON THE NORTH <br />SIDE OF BLUWOOD WITH TEL STIPULATION THAT THE CITY <br />RETAINS AN EASEMENT ON THAT SAME 10 FEET FOR UTILITY <br />PURPOSES <br />The foregoing resolution was duly <br />Ayes (5) Fahey, Scalze, Forsberg, <br />Nayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 7, Page 272. <br />seconded by Mrs. Scalze, <br />Nardini, Hanson. <br />Council recently tabled the Schabert property division request until <br />such time as consideration could be given to the vacation of a certain <br />portion of Bluwood Avenue. <br />Mrs. Scalze introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 81 -8 -402 - BRINGING FROM TABLE THE <br />SCHABERRT PROPERTY DIVISION REQUEST <br />The foregoing resol <br />Ayes (5) Scalze, Na <br />Noyes (0). <br />Resolution declared <br />This resolution app <br />Page 12 <br />ended by Mrs. Nardini. <br />anson, Fahey. <br />Book No. '(, Page 273. <br />
