Hanson <br />DATE: October 21, 1994 <br />TO: Mayor Hanson and Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />RE: Survey of Barbed Wire Fences <br />On Thursday, October 20, 1994, I toured the City looking for the <br />existence of barbed wire fences where a commercial or industrial <br />zoning district abuts a residential district. (Please note that <br />I did not do inspection within residential districts to see if <br />barbed wire fences may or may not exist.) Based on the survey, I <br />found that seven barbed wire fences exist meeting the above <br />criteria. One of them is the McCumber fence which was installed <br />this past April and has been subject to enforcement action. <br />Another is the fence along the water tower which the Council has <br />ordered removed. <br />It is my opinion that the remaining fences would likely be <br />lawfully existing nonconforming uses in that their age would <br />appear to predate the enactment of the prohibition of barbed wire <br />fences abutting residential districts which was adopted in 1980. <br />It should also be noted that given the Rice Street redevelopment <br />project, three of these fences could possibly be eliminated if <br />the development proposal goes forward. One of the two remaining <br />fences may also be addressed through the planned upgrade to the <br />property in question. At that time, it may be possible to <br />negotiate the removal of the barbed wire portion of the fence, <br />thereby bringing it into compliance. If we are successful in <br />these areas, only one fence would remain in addition to the <br />McCumber fence. <br />Based on this information as well as the report presented at our <br />last Council meeting, further direction from the Council is <br />needed to determine how we should proceed.
