4. City shall be solely responsibility for direct payment <br />of any fees or charges to the Metropolitan Waste Control <br />Commission, State of Minnesota or any of its subdivisions, and <br />Ramsey County as may be required by law affecting development and <br />issuance of building permits within its borders. <br />5. City, its officers, agents, and employees shall <br />cooperate with and assist Building Official in the orderly <br />performance of services to be provided for herein. <br />6. All applications for building permits and building <br />inspection forms to be utilized hereunder shall be provided by <br />City. <br />7. City, its officers, agents, and employees do not assume <br />liability for any negligent or intentional acts of Building <br />Official or any of its officers, agents, or employees and <br />Building Official shall indemnify and defend City, its officers, <br />agents, and employees against and hold City, its officers, <br />agents, and employees harmless from any claims, causes of action, <br />damages, loss, cost, or expense resulting from or related to the <br />actions of Building Official, its officers, agents, or employees <br />in the performance of this Agreement. <br />8. Building Official, its officers, agents, and employees <br />do not assume liability for any negligent or intentional acts of <br />City or any of its officers, agents, or employees. City shall <br />indemnify and defend Building Official, its officers, agents, or <br />employees against and hold Building Official, its officers, <br />agents, and employees harmless from any claims, causes of action, <br />damages, loss, cost or expense resulting from or related to the <br />actions of City, its officers, agents, or employees in the <br />performance of this Agreement. <br />9. It is understood that enforcement and administration of <br />the Minnesota State Building Code is a public service and is of <br />necessity limited in nature. Consequently, building permits and <br />the subsequent building inspections are not to be construed or <br />relied upon as any type of warranty, guarantee, or representation <br />on the part of Building Official that the plans, construction, or <br />finished product are necessarily in conformance with the <br />provisions of the Minnesota State Building Code or other <br />application construction standards. <br />10. It is understood that this Agreement contains the <br />entire agreement between City and Building Official and that no <br />statement, promise, or inducements have been made to any party <br />hereto, or any officer, agent or employee of either party hereto <br />which is not contained within this written Agreement. This <br />Agreement may not be enlarged, modified, or altered except in <br />writing signed by the parties and endorsed herein.
