The lot <br />adjacent to the applicant's property to the west is not in conformance with the minimum lot <br />width and minimum side yard setback standards. The adjacent lot has an existing house which <br />is currently setback from the adjoining property line 1.8 feet. The width of the adjacent lot is <br />65 feet. <br />Property sale. The applicant has requested a subdivision to divide a 10' X 570' parcel from <br />her property in order to sell that parcel to the adjacent property owner. The intent of this sale <br />is to distance the adjacent property owner's home from the adjoining property line. <br />Resulting conformity. The approval of the requested subdivision and subsequent land sale <br />would result in the adjacent lot being brought into conformance with side yard setback standards <br />and minimum lot width. The property sale would result in the adjacent property owner's <br />existing house being setback 11.8 feet from the adjoining property line and increase the lot with <br />to 75 feet. Thus the property would conform to all lot performance standards for a R -1 district. <br />CONCLUSION <br />This requested subdivision will make possible the elimination of an existing non - conforming lot <br />by making the adjacent conform with Zoning Ordinance standards for side yard setbacks and lot <br />width. The decision to approve the requested subdivision is a policy matter to be determined by <br />City Officials, however our office recommends the City approve the subdivision request due to <br />the considerations outlined within this report. <br />pc: Kathy Glanzer <br />Eileen M.
