This will
necessitate curb cuts, loading pads, ped ramps from
sidewalks down to the street, and other incidentals which
will be a cost to the city. This type of work will not be
required immediately and MTC will be seeking additional
funds to help offset these future costs.
The League of Minnesota Cities Insurance Trust has reviewed
this maintenance agreement and found it acceptable from the
standpoint of apropriately assigning liability to each
respective party. It is also my opinion that by not
signing the agreement, we may incur that liability
ourselves and still have responsibility for costs in
maintaining bus stop areas.
Therefore, it is my recommendation that both the agreements
be adopted in the form as presented. The City Attorney may
also have comments regarding the proposed agreements.
JRH:kpv
Enclosures
Page 110
