MTC CONTRACT NO, <br />DRAFT 7/26/93 <br />All such reports, graphics, plates, materials and computer <br />programming materials shall be delivered to the MTC as specified in <br />this Agreement, or upon termination thereof, and any use of those <br />items by anyone other than the MTC is prohibited without the prior <br />written approval of the MTC. MTC shall not deny the City to retain <br />copies or to use those items prepared or developed for the City for <br />its own use. Any reports, information, data, etc., prepared or <br />developed specifically under this agreement shall not be made <br />available to any individual or organization unless permitted by the <br />Data Practices Act of the State of Minnesota. <br />7. Equal Employment Opportunity <br />The parties to this agreement shall not discriminate against any <br />employee or applicant for employment because of race, religion, <br />color, sex, age, national origin or handicap and the parties shall take <br />affirmative action to insure that applicants are employed and that <br />employees are treated during their employment without regard to <br />their race, religion, color, sex, age, handicap or national origin. Such <br />actions shall include but not be limited to the following; <br />employment, upgrading, demotion or transfer; recruitment or <br />recruitment advertising; layoff or termination; rates of pay or other <br />forms of compensation; and selection of training, including <br />apprenticeship. <br />8. Disadvantaged Business Enterprises <br />The parties to this agreement shall provide small disadvantaged <br />businesses with the maximum opportunity to participate in the <br />provision of services and goods under this Agreement. <br />9. Interest of Members of Congress <br />No member of or delegate to the Congress of the United States shall <br />be admitted to any benefit arising therefrom. <br />10. Interest of Public Officials <br />No member, officer, employee or agent of the parties hereto during <br />their tenure or for one year thereafter, shah have any interest, <br />direct or indirect, in the Agreement or the proceeds thereof. <br />11.
