SECTION 917.010 GENERAL PROVISIONS <br />General Provisions: <br />Statutory Authorization. While not included in the City's existing <br />Shoreland Ordinance, the Model Ordinance suggests that reference to <br />legislative authority be made. Such a reference is considered <br />positive, especially in matters of potential appeal and has been <br />included in the attached draft ordinance. <br />Policy Statement. The Model Ordinance suggests that a statement of <br />policy be included in the Shoreland Ordinance. The policy <br />statement, as included in the draft ordinance, basically states <br />that it is in the best interest of Little Canada to regulate <br />development of shorelands of public waters. <br />SECTION 917.020 DESIGNATION OF TYPES OF LAND USE <br />Shoreland Management Classification. As listed in Little Canada's <br />current Shoreland Ordinance, qualifying waterbodies within the City <br />are specifically identified in the draft ordinance. Areas subject <br />to shoreland regulations have also been identified on the City's <br />official zoning map. <br />Shoreland District. This section of the draft ordinance basically <br />states that the Shoreland District functions as an overlay where <br />permitted and conditional uses in the base zoning district are <br />allowed. While this reference is a carryover from the existing <br />Shoreland Ordinance, the draft ordinance has been expanded to <br />provide specific regulation for substandard uses. <br />SECTION 917.030 ZONING PROVISIONS <br />Minimum Lot Area. This section of the draft ordinance establishes <br />minimum lot area requirements for various uses within the Shoreland <br />Overlay District. In contrast to the City's existing ordinance, <br />the draft ordinance makes specific provision for single family <br />homes, duplexes, triplexes, and quads. Such regulation has been <br />duplicated from the Model Ordinance. <br />Setbacks. This section of the draft Shoreland Ordinance <br />establishes setback requirements for recreational and general <br />development lakes. In comparison to the City's existing Shoreland <br />Ordinance, the following setbacks have been added: <br />From top of bluff - 30 feet <br />From unplatted cemetery - 50 feet <br />Impervious Surface Coverage. The City's existing Shoreland <br />Ordinance currently requires that impervious surface coverage not <br />Page 20 <br />
