AMENDMENT <br />This amendment dated , 1994 amends the <br />development contract dated October 28, 1993 by and between the <br />City of Little Canada, a Municipal Corporation, ( "City ") and Carl <br />G. Swanson and Barbara A. Swanson, husband and wife, <br />( "Developers "). <br />Paragraph 10 of the development agreement is hereby modified <br />to read as follows: <br />10. Completion and Acceptance of the Project by the City. <br />No building permit shall be issued by the City until the <br />installation of sanitary sewer, storm sewer, water main, curb and <br />gutter, and the first lift of bituminous, except that a building <br />permit for a model home on Lot 2, Block 1 may be allowed pursuant <br />to the provisions of paragraph No. 18. <br />18. Building Permit for a Model Home. A building permit <br />for a model home on Lot 2, Block 1 shall be allowed subject to <br />the following conditions. They are as follows: <br />* Building elevation and setbacks are to be established <br />and documented by registered survey or in accordance <br />with the approved grading plan and City ordinance <br />requirements. <br />* Receipt of evidence of County approval for a road <br />access permit for Schletty Drive. <br />* All vehicles not delivering supplies to the site shall <br />be parked on Little Canada Road. Said parking on <br />Little Canada Road is to be allowed only on week days <br />between the hours of 7:00 a.m. and 5:00 p.m. subject to <br />1 <br />Page 12 <br />
