MINUTES <br />• City Council <br />Oct. 23, 1985 <br />Boss <br />Addition <br />(Cont.) <br />Rezoning <br />Of Strohbeen <br />Property <br />Agenda <br />Item No., <br />Mr. Collova asked the cost of adding a water stub at this time. <br />The Engineer replied that the cost would be around $300. Mr. Boss <br />felt that the cost of the radius was $300 as well. <br />The Engineer pointed out that the City has done this in the past. <br />Mr. Blesener replied that if this was the case, it was acceptable <br />to him. Blesener stated that in regard to the house he would like <br />to see a letter drawn up by the City Attorney and signed by Mr. <br />Boss stating that no building permit will be issued for Lot 2 until <br />the house is torn down. Mr. Boss stated that this was acceptable <br />to him. <br />Mr. Gene Fasciana questioned that the house is not located on that <br />lot, but rather on the alleyway as reported by Mr. Boss. Mr. Boss informed <br />Mr. Fasciana that the property irons are in and he can see the location <br />of the house from them. Boss stated that a corner of Lot 2 may touch <br />the house. <br />Fasciana asked how Mr. Boss could obtain title to the house if it is <br />not on his property. Mr. Boss replied that the house sits on his <br />property through adverse possession. Fasciana commented that he did <br />not think adverse possession applied on public property. <br />Mr. Blesener pointed out that in a sense the City is considering the <br />house on Lot 2 of the Boss property and the City is precluding <br />development of this lot until the house is removed. <br />Mrs. Fasciana asked how they could get clear title to their property <br />with the location of this house. Mr. Fahey suggested that the <br />Fasciana's consult an Attorney on this. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 85 -10 -518 - APPROVING THE BOSS . <br />2ND ADDITION FINAL PLAT WITH THE CONDITION THAT <br />A WATER STUB BE ADDED TO LOT 4 AT THE CITY'S EXPENSE <br />ON THE CONDITION THAT MR. BOSS DEDICATE TO THE <br />CITY THE RADIUS OF THE CORNER AT JACKSON AND BRYAN <br />STREETS <br />The foregoing resolution was duly seconded by Ms. Nardini. <br />Ayes (4) Scalze, Blesener, Nardini, Collova. <br />Nayes (0). <br />Mr. Fahey abstained. <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 12, Page 547. <br />The City Attorney presented to the Council an ordinance pertaining <br />to the rezoning of the Strohbeen property at the corner of Little <br />Canada Road and Ncel Drive. <br />Pay: -?.1- <br />Page 7 <br />
