8. Arterial streets. <br />4.1.1.b. Appendix "A2" shall be used to calculate the fee for all other <br />types of normal construction projects. <br />4.1.2. "Construction cost of the Project" as herein referred to means the <br />total cost of all work designed or specified by the Consultant for the <br />Project, including Change Orders resulting from the City's request to <br />change the scope of the Project but not including those caused by the <br />Consultant's errors or oversights in design and less any costs associated <br />with any quantity overruns not resulting from a City requested change in <br />project scope, but does not include any payments to the Consultant or other <br />consultants, surveyors, lawyers, appraisers, testing companies, etc., the <br />cost of the land, right -of -way or easements, nor other costs which are the <br />responsibility of the City as provided herein in SECTION 3. <br />4.1.3. Progress payments to the Consultant shall be made in proportion to <br />services performed. The compensation for Basic Services shall be paid <br />according to the following percentage of the fee specified in Section 4.1.1 <br />at completion at each phase of the work: <br />a. Upon completion of the Preliminary Report Phase the City will <br />pay to the Consultant a sum equal to 20% of the Consultant's fee <br />based on Schedule "Al" or "A2" or a sum based upon the actual <br />time spent at the rates shown on Schedule "B" attached <br />whichever is less. <br />b. Upon completion of the Final Design Phase the City will pay to <br />the Consultant a sum equal to 85% of the Consultant's fee based <br />on Schedule "Al" or "A2 ", based upon the total amount of the <br />contract for the Project let by the City, less any sum <br />previously paid. <br />c. For services rendered in the Construction Phase the City will <br />pay to the Consultant a sum equal to 100% of the Consultant's <br />fee based on Schedule "Al" or "A2 ", based upon the actual total <br />construction cost of the Project, less any sum previously paid. <br />Payments will be made monthly in direct proportion to the <br />construction work completed. <br />4.1.3.1. In the event alternatives being evaluated are beyond what one <br />would consider reasonable given the nature of the project, the Engineer <br />Page 89 <br />
