MINUTES <br />CITY COUNCIL <br />OCTOBER 10, 2013 <br />AUTO - <br />RELATED <br />USE <br />MORATORIUM <br />The City Planner noted his September 9, 2013 report relative to the auto - <br />related use moratorium that is in effect. He pointed out the discussion at <br />the last Planning Commission meeting relative to the issues outlined in <br />that report: motor vehicle sales, indoors; salvage vehicle sales and repair; <br />and limitations on the variety of licenses that a business owner can hold. <br />The Planner noted that since that meeting, City staff put together an <br />inventory chart of each of the licenses that the various Ryan Industrial <br />Park businesses hold. Based on that inventory, the determination was <br />made that it is not the combination of licenses that is causing enforcement <br />problems in the park. It appears that the largest percentage of enforcement <br />problems occurs because of the Auto Salvage Repair License. Based on <br />this analysis, the City Planner indicated that it is staff's recommendation <br />that the additional regulations relative to Motor Vehicle Sales, Indoors as <br />outlined in his September 9, 2013 report be enacted. Staff is also <br />recommending the elimination of' the Auto Salvage Repair License, and <br />that the number of Motor Vehicle Sales, Outdoors licenses be reduced <br />from four to three to reflect the current number of active Licenses. The <br />Planner pointed out that Ryan Industrial Park was never intended to be a <br />retail location. <br />Duray asked how many Auto Salvage Repair Licenses have been issued. <br />The City Planner indicated that there are two active licenses. The City <br />Administrator indicated that the Benchmark Auto license has been active <br />for some time; the Nova Auto Nation license is more recent. The City <br />Planner pointed out that if the Auto Salvage Repair License is eliminated, <br />the current license holders would be grandfathered in. Those licenses <br />would lapse if they were inactive for a period of at least one year. With <br />regard to enforcing the distinction between a Major Auto Repair License <br />and an Auto Salvage Repair I.,icense, the Code Enforcement Officer noted <br />that she is able to run the license plates of vehicles being worked on to <br />determine whether or not they have salvage titles. An Auto Salvage <br />Repair License is required in order to work on these vehicles. <br />The Planner noted the recommended regulations relative to Motor Vehicle <br />Sales, Indoors and indicated that staff also explored creating special <br />regulations for repair licenses. however, given the bulk of the issues <br />related to the Indoor Sales Licenses, staff felt only those additional <br />regulations were needed. <br />There was discussion on the method for moving this zoning issue forward, <br />and the consensus was to follow the normal zoning process, sending <br />notices to the owners in Ryan Industrial Park along with the City Planner's <br />report. This will give the owners an opportunity to review the Planner's <br />recommendations prior to the meeting. <br />6 <br />
