Kelly <br />jkel lyCkel lyandl emmons.com <br />Re: Update to Ordinance 802 <br />Dear Mr. Hanson, <br />I have reviewed correspondence from Ramsey County Tobacco Coalition ("RTC") and conducted <br />research regarding regulation electronic cigarettes or "E- Cigarettes." I have recommended snaking <br />updates to regulate the sale, display, disposal and use of E- Cigarettes within the City of Little <br />Canada. The updates include the following: <br />I. Delivery Devices. Amending the language defining nicotine and lobelia delivery devices to <br />include any delivery device whereby a substance is consumed through inhalation. The <br />recommendations from RTC appear to be too narrow and short- sighted in my opinion. The <br />new definition covers any type of technological advance that may occur, including asthma <br />inhaler style products not approved by the FDA for smoking cessation. I recommend <br />amendments throughout reinoving the phrase "nicotine and lobelia" and adding "delivery <br />device" any place there is a reference to sale, use or distribution of tobacco or tobacco <br />products.
