PERMANENT HIGFIWAY EASEMENT The undersigned GRANTOR for and in consideration of Thirty -six Thousand Six Hundred Sixty and 00 /100 Dollars (536,660.00) and other good and valuable consideration, the receipt whereof is hereby acknowledged, does hereby grant and convey to County of Ramsey, a political subdivision of the State of Minnesota, GRANTEE, its successors and assigns, a perpetual easement (the "Easement ") for highway and utility purposes over, under and across the real property depicted on attached Exhibit "A" and legally described on attached Exhibit "B" (the "Easement Area "). The Easement GRANTOR hereby grants to GRANTEE is a perpetual easement for all public highway and utility purposes, with the right to enter upon the Easement Area at any time the GRANTEE may see fit, for the purpose of constructing, reconstructing, operating, maintaining, and /or repairing highway and utility appurtenances on, over, across, through and under the Easement Area; including but not limited to pavement, boulevards, paths /sidewalks, pipes, signage, signals, structures, excavations, embankments, poles, lines, equipment, and any other items related to highway and utility functions, GRANTEE has further right to remove trees, bushes, undergrowth, and other features and improvements within the Easement Area, which may interfere with highway and utility functions. For recording purposes and without limiting the area described in Exhibit B, the Easement applies generally to the real property described on attached Exhibit "C ". If there is a conflict with the description of the Perpetual Easement, the language of Exhibit 13 shall govern. IN WITNESS WHEREOF, GRANTOR has executed this Easement as of the day of , 2013.
