AGREEMENT <br />THIS AGREEMENT, MADE THIS _ day of December, 2013 by and between the City of <br />Little Canada, a municipal corporation of the State of Minnesota (hereinafter referred to as <br />"City ") and Dirk Bordsen, an individual, hereinafter referred to as "Developer "). <br />WITNESSETH: <br />WHEREAS, Developer owns the property at 2962 Rice Street (Ramsey County Property <br />Identification Number 06- 29- 22- 23- 0029), and <br />WHEREAS, Developer is acquiring the property at 2968 Rice Street (Ramsey County Property <br />Identification Nutnber 06- 29- 22- 23- 0028), and <br />WHEREAS, Developer has applied for Planned Unit Development (PUD) zoning approval for <br />both parcels through the City that was considered by the Planning Commission at their meeting <br />of October 10, 2013 (Attachment A) and the City Council at their meeting of October 23, 2013 <br />(Attachment B), and <br />WHEREAS, Developer was seeking allowances for the City's zoning code relating to site <br />development standards due to cost constraints and the goal of redeveloping the parcels in the <br />next five to ten years, and <br />WHEREAS, a PUD permit allowing interim uses was approved by the Council pursuant to <br />Resolution 2013 -10 -192 for 2968 Rice Street and Resolution 2013 -10 -193 for 2962 Rice Street, <br />and <br />WHEREAS, the Developer and City want to cooperate with each other should future <br />redevelopment of these parcels be feasible at some time in the future, and <br />NOW THEREFORE, the City and Developer agree as follows: <br />1. The City has approved an interim use permit as part of a planned unit development <br />(PUD) for 2968 Rice Street to allow mixed use commercial purposes conditioned upon <br />the following: <br />A. Developer's acquisition of the property. <br />B. Parking and circulation areas are paved and striped to provide adequate levels of <br />parking based on commercial use of all buildings. Paving is to be completed by <br />June 30, 2014. <br />C. Areas not utilized for buildings or parking are to be landscaped to create green <br />space in accordance with the common commercial zoning requirements. <br />D. A site and building plan must be submitted and all necessary permits obtained. <br />22 <br />
