MnDOT is <br />requesting municipal consent for this project as required by State Statutes 161.162 through <br />161.167. <br />State Statute 161.163 states that municipal consent applies only to projects that alter access, <br />increase or reduce highway traffic capacity, or require acquisition of permanent rights of way. <br />State Project 6285 -149 will not alter access or increase highway traffic capacity. MnDOT does <br />need temporary right of way from Mr. Frank Frattalone in order to construct the wall that will <br />stabilize the slope. Mr. Frattalone has requested MnDOT purchase permanent right of way of his <br />property, which is a remnant land- locked parcel covered with a wetland, instead of temporary right <br />of way as planned. Because of Mr. Frattlone's request, MnDOT will have acquisition of permanent <br />rights of way with this project. As a result, municipal consent is required for this project. <br />State Statute 161.164 states that the city shall: <br />• Schedule a public hearing within 15 days of receiving the request for municipal consent. <br />• Conduct the public hearing within 60 days of receiving the request for municipal consent. <br />• Provide a 30 -day notice of the public hearing. <br />• Approve or disapprove the request by resolution within 90 days of the public hearing. <br />Because the nature of this project is a maintenance project and consists of constructing a soldier <br />pile wall, no official layout has been prepared. The attachments to this document provide location <br />and land impact information. The soldier pile wall will be constructed with a concrete facing that <br />meets the same visual quality requirements as the other walls within the Unweave the Weave <br />project area. <br />Project Limits and Route Location <br />This project is located on 1 -694 eastbound connecting to I -35E southbound.
