Section 903.020 D.4 of the City Code states: "The total floor area of a garage and other <br />accessory buildings for a single family detached dwelling shall not exceed one thousand <br />(1,000) square feet of floor area per lot except by conditional use permit ". The site plan <br />indicated that there are no other accessory garages located on the subject property, however, <br />the applicant should be aware that any additional accessory building will require a conditional <br />use permit. <br />As shown in Exhibit B, the proposed garage is to be set ten (10) feet back from what our <br />office determines to be the "rear" property line. Our determination is based on the irregular <br />shape of the lot, and the fact that this lot line is the rear lot line for the adjacent property to the <br />north. This ten foot setback meets the required rear yard setback of ten (10) feet. All are <br />required setbacks are met by the proposal. <br />Section 921.010 c. of the Municipal Code requires the City to consider possible adverse affects <br />of the proposal. Its judgement shall be based upon but not limited to the following factors: <br />1. The proposed action has been considered in relation to the specific policies and <br />provisions of and has been found to be consistent with the official City Comprehensive <br />Land Use Plan. <br />2. The proposed site is or will be compatible with the present and future land uses of the <br />area. <br />3. The proposed use conforms with all performance standards contained herein. <br />4. The proposed use will not tend to or actually depreciate the area in which it is <br />proposed. <br />S. The proposed use can be accommodated with existing public services and will not <br />overburden the City's service capacity. <br />The intent of the requirement to conditionally permit garages in excess of one (1), is to afford <br />the City some regulation on the use and placement of such additional structures. Specifically: <br />Preventing an illegal business, such as commercial storage or car repair, from being operated; <br />Ensuring proper building materials are used; Ensuring that the garage is in scale with the <br />home; Allowing the City to require screening from adjacent residential properties if necessary. <br />The proposal to construct an additional detached garage, for the purpose of adding additional <br />storage space of personal belongings such as a boat, will not have any adverse effects on <br />existing city services such as water, sewer, police and fire, nor will the request diminish <br />property values within the area. <br />2 <br />Page 4 <br />
