The one point of concern relates to an existing accessory structure which is located on top of <br />the proposed property dividing line. The applicant is proposing to remove this structure from <br />the property, therefore, a condition of approval of the proposed lot split shall be that the <br />garage must be removed by October 31, 1995, which should afford the applicant a reasonable <br />amount of time in which to remove the building from the site. <br />With the removal of the accessory building, the subdivision of the property follows the City <br />procedural policy per Section 1001.060 of the City Subdivision Ordinance which states: <br />EXCEPTIONS: When requesting a subdivision, if the following condition exists, the <br />City Clerk shall bring the request to the attention of the Planning Commission and City <br />Council whereupon, the said request shall be reviewed and the City Council, following <br />receipt of a recommendation from the Planning Commission, may relieve the <br />subdivider from complying with any procedural requirements of this Ordinance that are <br />deemed appropriate. <br />(a) In the case of a request to divide a lot where the division is to permit the adding <br />of a parcel of land to an abutting lot or to create two lots and the newly created <br />property line will not cause the other remaining portion of the lot or any <br />structure to be in violation with this Ordinance or the Zoning Ordinance. <br />RECOMMENDATION <br />The proposed subdivision of Mr. White's property into two separate parcels is in conformance <br />with the City Code, therefore, our office recommends approval of the subdivision provided <br />that the accessory structure is removed by no later than October 31, 1995. <br />pc: Kathy Glanzer <br />Thomas White <br />Greg Schmidt <br />Dave Harris <br />2 <br />Page 4 <br />
