ANALYSIS <br />As mentioned, Section 903.020 D.4 of the City Code states: "The total floor area of a garage <br />and other accessory buildings for a single family detached dwelling shall not exceed one <br />thousand (1,000) square feet of floor area per lot except by conditional use permit ". <br />The property contains a 170 square foot accessory building and a 616 square foot garage, <br />totaling 956 square feet. The proposed 517 square foot garage will increase the total square <br />footage of garage and accessory buildings to 1,303 square feet, therefore, a conditional use <br />permit is required. <br />Section 921.010 c. of the Municipal Code requires the City to consider possible adverse affects <br />of the proposal. Its judgement shall be based upon but not limited to the following factors: <br />1. The proposed action has been considered in relation to the specific policies and <br />provisions of and has been found to be consistent with the official City Comprehensive <br />Land Use Plan. <br />2. The proposed site is or will be compatible with the present and future land uses of the <br />area. <br />3. The proposed use conforms with all performance standards contained herein. <br />4. The proposed use will not tend to or actually depreciate the area in which it is <br />proposed. <br />5. The proposed use can be accommodated with existing public services and will not <br />overburden the City's service capacity. <br />The intent of the requirement to conditionally permit garages /accessory buildings that exceed <br />1,000 square feet is to afford the City some regulation on the use and placement of such <br />structures. Specifically, preventing illegal businesses from being run, ensuring proper building <br />materials are used, ensuring that the garage /accessory buildings are in scale with the home, <br />and adequate screening from adjacent residential properties. <br />The proposal to construct additional garage space for the purpose of adding indoor storage <br />space to an existing home will not have any adverse effects on existing city services such as <br />water, sewer, police and fire, nor will the request diminish property values within the area. <br />The proposed improvements are in keeping with the architectural integrity of the existing <br />home. Further, as shown on the site plan (Exhibit B) the existing home is very large, <br />therefore, the proposed additional garage space will remain in scale with the existing home. <br />2 <br />Page 6 <br />
