sick leave or vacation benefits will be earned while receiving <br />compensation payments for time exceeding three (3) months. <br />(E) In order to be eligible for sick leave with pay, an <br />employee must: <br />1. Report promptly to such employee's Department Head <br />the reason for the absence. <br />"2. Keep such employee's Department Head informed of such <br />employee's condition, if the absence is more than <br />three (3) days duration. <br />3. Submit a medical certificate for any absence <br />exceeding three (3) days if required by the <br />Department Head. <br />(F) The misuse of sick leave, such as claiming sick leave <br />when physically fit, shall be grounds for immediate dismissal. <br />(G) Sick leave shall not be granted for less than <br />one -half day. <br />(H) Sick leave credit shall not accrue to any employee <br />during any period of suspension, layoff, leave of absence or other <br />off payroll status. <br />(I) In lieu of sick leave pay, for any absence not <br />exceeding two (2) days, an employee may elect to take leave without <br />pay or use compensatory time. <br />209.130. IEAVES.OF ABSENCE AND EMERGENCY LEAVE. <br />(A) After receiving a recommendation of the Department <br />Head, the City Council may approve a leave of absence of an <br />employee without pay for a period which shall not exceed ninety <br />(90) calendar days. <br />(B) In the event an employee is unable to report for work <br />because of extreme weather conditions (e.g.. winter blizzard), such <br />employee may, upon the approval of the Department Head, be granted <br />leave without pay or use vacation or use compensatory time for the <br />day or days in question. Such employee may also be allowed, upon <br />approval of the Department Head, to make up the time lost at <br />straight time rate by working extra hours before or after his /her <br />regular shift, provided that all such time is made up within the <br />pay period in which the emergency leave day or days occurred. <br />209.140. JURY AND WITNESS DUTY. If an employee is called <br />to serve as a juror or subpoenaed as a court witness, the employee <br />shall receive compensation which will equal the difference between <br />the employee's regular pay and compensation paid for jury duty or <br />witness fees.
