(10).Conduct in private life which brings discredit or has <br />an adverse impact upon the municipal service (e.g. <br />conviction of a felony). <br />(11) Theft, attempted theft or misappropriation of City <br />property, regardless of value, or proven dishonesty <br />in the performance of such employee's duties. <br />s' as . <br />.:(12) Deliberately filing or making a false or improper <br />report or statement or deliberately withholding <br />pertinent information relating to established <br />procedures for the efficient operation of City <br />government. <br />(13) Conduct or actions which create or may create a clear <br />conflict of interest with such employee's position, <br />duties and responsibilities as a City employee. <br />(14) Insubordination. <br />(15). An employee may also be dismissed pursuant to the <br />;4 3 provisions of Section 209.210 of this Chapter dealing <br />with political activity. <br />(B) Hearings Required: <br />(1) In.. cases involving . dismissal, demotion, or <br />suspension, the employee shall have ten (10) days <br />_:_,___._(excluding weekends and holidays) - following receipt <br />;..—. ;,,_ ..of the City Council's written notice of action to <br />bns ;ar.,, file a written request with the City Clerk for a <br />hearing before the City Council. ..If the employee <br />does not request such a hearing within such ten (10) <br />day period, he will be deemed to have waived such <br />A. right and the original decision of the City Council <br />shall be final and not subject. to further review. <br />The hearing shall not be held later than ten (10) <br />days from the date of filing of the employee's <br />written request for a hearing. The Council will <br />issue a written decision to the employee within ten <br />(10) days following the hearing. All time periods <br />herein shall exclude weekends and holidays. <br />If the employee is not satisfied with the decision of <br />the City Council, following the hearing, such <br />employee may request an independent review of the <br />matter by application to the public employment <br />relations panel as provided by the applicable <br />Minnesota Statutes. <br />(4) The rights of any employee, if such employee is <br />exonerated and reinstated to such employee's former <br />position, shall be retroactive to the effective date <br />of the disciplinary action. <br />Page 39 <br />Page 36 <br />
