(A) At residential dwelling units, containers for garbage, <br />rubbish, recyclable materials, leaves and lawn clippings shall be <br />placed on the curb no more than twenty -four (24) hours before the <br />designated pick -up day. Bulky items shall be placed on the curb no <br />more than twenty -four (24) hours before the designated pick -up day. <br />(B) At commercial and industrial establishments, every <br />property owner, occupant or owner shall place containers used for <br />the storage of garbage, recyclables, and rubbish at or near the <br />back door of the building using the same, or at the rear of the <br />property if there is an alley. Such containers shall be accessible <br />to garbage, recycling, and rubbish collectors at all reasonable <br />times. <br />809.080. COLLECTION REQUIRED. Every property owner or <br />occupant of a place of business, including mobile homes, town <br />houses, apartment buildings and condominiums, that accumulates <br />garbage, recyclable materials, and rubbish shall provide for lawful <br />collection thereof at such person's own expense at least once a <br />week or at such other times as the Health Officer may determine <br />necessary to protect the health and safety of the residents of the <br />City. If a property owner fails to provide for lawful collection <br />as required under this Section, the City may, upon ten (10) days <br />notice by certified mail, provide or contract for collection <br />services. The costs incurred shall be certified to the County <br />Auditor along with real estate taxes as a special assessment. <br />809.090 SERVICE CHARGE- RESIDENTIAL DWELLING UNIT. <br />(A) There is hereby imposed upon each single family dwelling <br />and each unit of a duplex, triplex or four -piex within the City, <br />from which garbage, recyclable materials, or rubbish is collected <br />or may be collected by the City or its representative, a monthly <br />charge for such services, which charge shall be billed quarterly in <br />accordance with schedules established by the hauler from time to <br />time by resolution of the City Council. <br />(B) If such quarterly charge is not paid within twenty -five <br />(25) days after the last day of the billing quarter, there shall be <br />a late charge of ten percent (10 %) of the amount owing for the <br />previous quarter added to the quarterly charge. If such quarterly <br />charge plus penalty is not paid within ninety (90) days after the <br />last day of the billing quarter, there shall be a late charge of <br />Thirty -five Dollars ($35.00) added to the unpaid amount. The City <br />Council may certify to the County Auditor with the taxes against <br />the property served the amount unpaid, which shall be collected as <br />other taxes are collected. <br />809.100. UNAUTHORIZED COLLECTION OF RECYCLABLE MATERIALS. <br />(A) The materials designated as recyclable materials shall be <br />the sole property of the City of Little Canada from the time set <br />out for collection by the residents until collection by the City or <br />its designated contractor. At the time of collection, items <br />designated as recyclable materials shall become the sole property <br />of the City or its designated contractor. <br />Page 120 <br />Page 101 <br />
