Hanson <br />Attached are copies of the City's Ordinance with regard to <br />deferment of special assessments. Please note Chapter 2901.020. <br />Hardship Defined. As you can see, in order to qualify for a <br />deferment the average annual payment of all assessments shall <br />exceed one percent of the applicant's adjusted gross income. <br />This ordinance has been in effect for quite some time, and was <br />amended in 1993 to include the development deferral option. <br />Under the existing ordinance, both Mr. and Mrs. Brown and Mr. and <br />Mrs. Radford would qualify for senior citizen deferrals. <br />Also attached is a copy of the State Statute outlining the <br />procedure to obtain a deferral. This Statute allows cities to <br />establish standards and guidelines for determine the existence of <br />a hardship. <br />At the last meeting, Council discussed their preference that the <br />qualifying factor for deferment approval be low income <br />guidelines. Attached is information received from Ramsey County <br />on household size /income ranges they use for Section 8 Housing <br />Programs. Should the decision be made to amend the ordinance <br />changing the hardship definition, Council would have to decide <br />whether to apply the "Very Low" category or the "Low -Mod" <br />category. Low -Mod is the range used in the Community Development <br />Block Grant Program. Both Mr. and Mrs. Brown and Mr. and Mrs. <br />Radford would qualify for senior citizen deferrals using the <br />"Low -Mod" income guidelines. <br />It is staff's recommendation that for purposes of the Brown and <br />Radford applications, the existing ordinance guidelines be used. <br />Both would qualify for the senior deferment using these <br />guidelines. Future applications would be judged on any <br />amendments the Council might make to the ordinance. <br />If staff's recommendation is acceptable, the Council would need <br />to approve senior citizen deferments for Mr. and Mrs. Brown and <br />Mr. and Mrs. Radford. <br />Page 62 <br />
