DEFERRED ASSESSMENTS <br />Chapter Page <br />2901. Deferred Assessments 268 -269 <br />2901. DEFERRED ASSESSMENTS. <br />2901.010. DEFERRED SPECIAL ASSESSMENTS FOR SENIOR <br />CITIZENS AND DISABLED PERSONS. The City Council, pursuant to <br />Minnesota Statutes 1974, Section 435.193 and amendments thereto, <br />may, at its discretion, defer the payment of special assessments <br />for any homestead property owned by a person sixty -five (65) years <br />of age or older or retired by virtue of a permanent and total <br />disability for whom it would be a hardship to make the payments. <br />2901.020. HARDSHIP DEFINED. A hardship may be deemed to <br />exist if the average annual payments of all assessments levied <br />against the subject property shall exceed one percent (1 %) of the <br />applicant's adjusted gross income as determined by his Federal Tax <br />Return filed in the year previous to the certification of the <br />levy. The average annual payment of an assessment shall be the <br />total cost of the assessment divided by the number of years <br />spread. The Council may also determine hardship on the basis of <br />exceptional and unusual circumstances not covered herein. <br />2901.030. EXISTING DOCUMENTS. Any person who is over <br />sixty -five (65) years of age or disabled and who has been granted a <br />deferment by reason of age or disability prior to the enactment of <br />this Ordinance shall be required to make application for a <br />continuation of said deferment pursuant to the provisions of this <br />Ordinance. Such applicants shall be required to show evidence of <br />hardship as herein defined in order to continue receiving a <br />deferment and a failure to qualify for a deferment shall result in <br />the termination of said deferment effective at a time chosen by the <br />City Council at its discretion. <br />2901.040. RENEWAL. The application shall be renewed <br />every fine (5) years and said application, obtainable from the City <br />Clerk, shall be submitted to the City Clerk at least thirty (30) <br />days prior to the expiration of said five (5) year period. <br />2901.050. APPLICATION. Application forms may be obtained <br />from the office of the City Clerk and shall be submitted to the <br />City Clerk together with any other required documents no later than <br />ten (10) days prior to the City Council meeting at which the <br />application is to receive consideration. <br />2901.060. INTEREST. Interest to be charged shall be in <br />the same amount as charged against non- deferred assessments under <br />the same bond issue and shall accrue on such deferred assessments <br />Page 268 <br />Page 63 <br />
