A. Collection Service. The resident owner shall pay <br />the Contractor one price for refuse service, and one <br />price for recyclable collection service as outlined <br />in Attachment "A ". <br />1. The residential dwelling unit price may be <br />subject to automatic revision effective the <br />first day of each year commencing in 1997 upon <br />request of the Contractor, with increases or <br />decreases being governed by the corresponding <br />change in the Consumer Price Index (U.S. City <br />average - all items), during the twelve -month <br />period immediately preceding January 1, for <br />which the data is available. Any increase is <br />subject to review and approval of the City. <br />The residential dwelling unit price <br />established after each such revision shall be <br />the price on which the next subsequent <br />revision shall be based. <br />2. The parties acknowledge that certain expenses <br />of the Contractor and its haulers may be <br />subject to rapid escalation in the future over <br />which the Contractor has no control. The <br />parties agree that these expenses include, but <br />are not limited to, disposal fees, worker's <br />compensation insurance, general insurance, and <br />fuel costs. The parties further agree that <br />upon adequate support and documentation of <br />said expense increases and approval of the <br />City, the residential unit price shall be <br />adjusted for each percentage increase in these <br />costs; provided, however, that the residential <br />unit price shall be adjusted only upon a 10% <br />or more aggregate increase in these costs per <br />year. <br />3. The parties further agree that the prices <br />stated herein shall be automati ally increased <br />for all increases of existing or the <br />imposition of new federal, state, local, or <br />other governmental agency excise taxes, sales <br />tax, surcharges, or other charges, subject to <br />approval of the City. <br />B. Additional Collection Services. Charges for pickup <br />of additional items and for additional service shall <br />be made directly to the resident owner by the <br />Contractor at the prices stated in Attachment B <br />hereto. Said prices shall be subject to change from <br />time to time by the Contractor based on changes in <br />disposal costs and subject to City approval. <br />9 <br />Page 81 <br />
