City will be done utilizing the "pay as you go" method. In this <br />method, the City would issue a note to Developer for eligible <br />project costs that City agrees should be reimbursed through tax <br />increment assistance. The note would be payable from future tax <br />increments generated by the District. At the conclusion of the <br />note's term, any unpaid balance is forgiven by Developer and no <br />future obligation exists on the part of City. The exact terms <br />and conditions of this process would be detailed in the Final a <br />Development Agreement referenced in Provision #11. <br />15. Term of Tax Increment Assistance. Developer <br />acknowledges that tax increment assistance to be provided to the <br />development shall not exceed a 15 year term with 13 years of <br />increment collections. <br />16. Reconstruction of Little Canada Road. Developer <br />acknowledges that they are aware that Little Canada Road is <br />scheduled for reconstruction by Ramsey County from Rice Street to <br />the Soo Line Railroad tracks in 1996. To the extent possible, <br />City will attempt to accommodate Developer's request for <br />modifications to the project that will meet their mutual <br />development objectives. Developer also understands that it will <br />be subject to special assessments pursuant to Minnesota Statutes <br />Chapter 429 in relation to this project. Developer will execute <br />a Waiver of Right to Appeal Special Assessments in an amount <br />determined by City based upon benefits received by the <br />development property. <br />17.
