expectation of accorded other persons. Any gift of cash shall <br />be deemed to be given in the expectation of receiving a more <br />favorable treatment and shall be deemed to be improper. <br />(10) Conduct in private life which brings discredit or has an <br />adverse impact upon the municipal service (e.g. conviction of <br />a felony). <br />(11) Theft, attempted theft or misappropriation of City property, <br />regardless of value, or proven dishonesty in the performance <br />of such employee's duties. <br />(12) Deliberately filing or making a false or improper report or <br />statement or deliberately withholding pertinent information <br />relating to established procedures for the efficient operation <br />of City government. <br />(13) Conduct or actions which create or may create a clear conflict <br />of interest with such employee's position, duties and <br />responsibilities as a City employee. <br />(14) Insubordination. <br />(15) An employee may also be dismissed pursuant to the provisions <br />of Section 209.210 of this Chapter dealing with political <br />activity. <br />(B) Hearings Required: <br />(1) In cases involving dismissal, demotion, or suspension, the <br />employee shall have ten (10) days (excluding weekends and <br />holidays) following receipt of the City Council's written <br />notice of action to file a written request with the City Clerk <br />for a hearing before the City Council. If the employee does <br />not request such a hearing within such ten (10) day period, he <br />will be deemed to have waived such right and the original <br />decision of the City Council shall be final and not subject to <br />further review. <br />(2) The hearing shall not be held later than ten (10) days from <br />the date of filing of the employee's written request for a <br />hearing. The Council will issue a written decision to the <br />employee within ten (10) days following the hearing. All time <br />periods herein shall exclude weekends and holidays. <br />(3) If the employee is not satisfied with the decision of the City <br />Council, following the hearing, such employee may request an <br />independent review of the matter by application to the public <br />employment relations panel as provided by the applicable <br />Minnesota Statutes. <br />(4) The rights of any employee, if such employee is exonerated and <br />reinstated to such employee's former position, shall be <br />retroactive to the effective date of the disciplinary action. <br />Page 32 <br />PAGE 68 <br />
