DEVELOPMENT CONTRACT <br />AGREEMENT, dated , 1995, by and between the CITY OF <br />LITTLE CANADA, a Minnesota municipal corporation, ( "City ") and Masterpiece <br />Homes, Inc., a Minnesota corporation, ( "Developer "). <br />1. Request for Improvement. The Developer has requested the City to <br />allow the construction of sanitary sewer, storm sewer, water main, curb and <br />gutter, bituminous roadways, signage, and lighting necessary for the <br />proposed plat of Cobblestone Village within the City of Little Canada to <br />serve the following described property, as shown on Exhibit A: <br />Lots 1 through 38, Block 1, Cobblestone Village, County of Ramsey, <br />State of Minnesota. <br />2. Conditions of Approval. The City hereby approves construction of <br />extensions of sanitary sewer, storm sewer, water main, curb and gutter, <br />bituminous roadways, signage, and lighting to serve the Cobblestone Village <br />plat, conditioned upon the Developer entering into this Agreement and <br />guaranteeing compliance with terms of this Agreement. <br />3. Compliance with Laws and Regulations. The Developer represents <br />to the City that to the best of its knowledge the construction of <br />improvements to serve the Cobblestone Village subdivision will comply with <br />all City, County, Metropolitan, State and Federal laws and regulations, <br />including, but not limited to, subdivision ordinances, zoning ordinances, <br />and environmental regulations; including wetland impact and mitigation. <br />The Developer shall obtain all necessary permits and consents for the <br />project including, but not limited to, the permit required by the Minnesota <br />Department of Health due to the water main extension, the permit required <br />from the Minnesota Pollution Control Agency for the sanitary sewer main <br />extension, any necessary approvals from Metropolitan Council- Wastewater <br />-1- <br />
