The City's claim
was for $2,546.64. Given the driver's policy had a limit of $25,000, the
insurance company is offering a prorated settlement, which would result in
$480 for the City. The Administrator recommended that the City accept
the settlement offer, noting that the alternative of suing and obtaining a
judgment would likely result in legal costs that would surpass and
resulting settlement amount.
Blesener introduced the following resolution and moved its adoption:
RESOLUTION NO. 2014 -1 -25 — ACCEPTING THE INSURANCE
SETTLEMENT AS RECOMMENDED BY THE CITY
ADMINISTRATOR AND AUTHORIZING THE MAYOR AND CITY
ADMINISTRATOR TO EXECUTE THE PROPERTY DAMAGE
RELEASE ON BEHALF OF THE CITY
The foregoing resolution was duly seconded by Montour.
Ayes (4).
Nays (0).
