MINUTES <br />PLANNING COMMISSION <br />APRIL 13, 1995 <br />NUMBER OF <br />VOTES TO <br />APPROVE <br />VARIANCES <br />AND CUP'S <br />TO THE <br />ZONING & <br />SUBDIVISION <br />CODES <br />MINNS <br />BUILDING <br />ORDINANCE <br />REVISIONS <br />Motion seconded by Knudsen. <br />Motion carried 4 to 2 (Garske and Schletty voted <br />against). <br />The City Planner reported that there are two clauses <br />in the Subdivision Code which the City Attorney has <br />indicated are in conflict with regard to the number <br />of votes necessary to approve variances to that Code. <br />At a recent meeting, the Council clarified the language <br />to eliminate the conflict. Variances to the <br />Subdivision Code require a simple majority vote of the <br />Council. Both Variances and Conditional Use Permits to <br />the Zoning Code require a super majority vote of the <br />Council. The Planner reported that the Council has <br />asked that the Planning Commission look at this issue <br />and recommend whether these approvals should be by <br />simple or super majority. The Planner pointed out the <br />survey done by City staff showing that the vast <br />majority of cities in the surrounding area require <br />simple majorities for these approvals. However, it <br />would not be out -of -line with what Metro cities are <br />doing to require super majority votes on these issues. <br />The Commission discussed this matter, and it was <br />pointed out that under a super majority two people on <br />the Council have the ability to control these matters. <br />Therefore, it was the consensus of the Commission that <br />a simple majority vote for Variances to the Subdivision <br />Code as well as Variances and Conditional Use Permits <br />to the Zoning Code would be more appropriate. <br />Mr. Knudsen recommended that a simple majority vote of <br />the City Council be required for Variances to the <br />Subdivision Code as well as Variances and Conditional <br />Use Permits to the Zoning Code. <br />Motion seconded by Carson. <br />Motion carried 6 - 0. <br />The Commission reviewed the Building Ordinance <br />revisions proposed by the Building Inspector. It was <br />noted that these revisions bring the Ordinance into <br />compliance with the actual practices of the City. <br />12 <br />Page 99 <br />
