Kajalski also pointed out that the <br />City needs to put additional properties on the tax <br />rolls. Kajalski indicated that Mr. Morelan has stated <br />that he would vote to approve the improvement of <br />Jackson Street if the right -of -way were 50 feet. <br />Therefore, the argument of street encircling his <br />property on three sides doesn't have any merit. If the <br />Morelan garage is too close to the road, that is <br />because the garage was constructed within the setback. <br />Kajalski pointed out that no variance was granted for <br />the garage. Kajalski also pointed out that Mr. and <br />Mrs. Morelan bought the property knowing that the <br />Jackson Street road right -of -way existed. <br />Morelan felt that there was good justification in the <br />Subdivision Code for requiring residential road right - <br />of -ways at a minimum of 50 feet. The width of the <br />right -of -way maintains adequate distances between the <br />road surface and adjacent properties. Morelan stated <br />that a 40 foot right -of -way would jam the road in next <br />to his property. <br />Knudsen asked if there was adequate right -of -way on <br />Bluwood for a cul -de -sac. <br />The City Planner replied that there was since there is <br />a 90 foot right -of -way for Bluwood. There is only a 40 <br />foot right -of -way for Australian. <br />Keis asked if the Bluwood cul -de -sac would eat into <br />Morelan's front yard. <br />Morelan replied that the street is not in the center of <br />the Bluwood right -of -way, but more to the north. <br />Morelan indicated that the cul -de -sac would impact some <br />trees on the Cossack property. However, Mr. Cossack <br />has indicated at one of the neighborhood meetings that <br />he favors the cul -de -sac rather than the improvement of <br />Jackson Street. <br />Keis asked the standard radius for a cul -de -sac. <br />The City Planner replied that 45 feet is the standard <br />since it is the minimum within which a school bus can <br />turn around. 40 feet allows other service -type <br />vehicles to turn around. <br />7 <br />Page 32 <br />
