RESOLUTION FOR VACATING ROAD RIGHT -OF -WAY AND UTILITY EASEMENT <br />WHEREAS, <br />The City Council of Little Canada has determined to vacate the <br />following drainage and utility easement over said property: <br />That part of Minnesota Avenue as platted in J.F. <br />Eisenmenger's Garden Lots, Ramsey County, Minnesota lying <br />between the northerly extensions of the west line of Lot 48 <br />and the east line of Lot 45 in said J.F. Eisenmenger's <br />Garden Lots. <br />The road easement as shown on Registered Land Survey No. <br />300, Ramsey County, Minnesota which covers the south 33 feet <br />of the east 236 feet of Tract A said Registered Land Survey <br />No. 300. <br />AND WHEREAS, <br />A public hearing was held on the 12th day of April, 1995 before <br />the City Council in the City Hall after due published and posted <br />notice had been given by the City Administrator, a reasonable <br />attempt was made to give personal notice to all affected property <br />owners, and all persons interested were given an opportunity to <br />be heard; <br />AND WHEREAS, <br />Any person, corporation or city owning or controlling easements <br />contained upon the property vacated, reserves the right to <br />continue maintaining the same or to enter upon such way or <br />portion thereof vacated to maintain, repair, replace, remove or <br />otherwise attend thereto; <br />AND WHEREAS, <br />It appears that it will be in the best interest of the city to <br />vacate such road right -of -way and utility easement; <br />AND WHEREAS, <br />Four - fifths of all members of the City Council concur in this <br />resolution; <br />NOW, THEREFORE, BE IT RESOLVED, that the above - described road <br />right -of -way and utility easement is hereby vacated. <br />Adopted by the Council this 12th day of April, 1995. <br />Approved: <br />Attest: <br />Michael I.
