375539 <br />• Requires Minnesota Public Utilities Commission ( "PUC ") to <br />promulgate uniform statewide standards and regulations to accomplish <br />the intent and policy of the Act. <br />• Allows municipalities, which are referred to as "local authorities," to <br />require and issue permits from providers of emerging communications <br />services requiring them to comply with statewide minimum standards <br />and local requirements. <br />• Instructs local authorities to enforce PUC established construction and <br />safety standards, and customer service and technical standards. <br />• Grants a local authority the right to require a provider of emerging <br />communications services to serve the entire municipality and prohibit <br />"redlining" and /or "cherry picking." <br />• Permits local authorities to obtain compensation for the use of public <br />property or public rights -of -way and to recover regulatory /permitting <br />costs. <br />• Allows local authorities to require the reservation of space-/use on <br />emerging communications services for public use. <br />• Gives local authority the right to reserve "public space" on emerging <br />community services. <br />B. AUTHORITY FOR USE OF RIGHT -OF -WAY TO PROVIDE <br />EMERGING COMMUNICATIONS SERVICES <br />1. Permitting authority. <br />• Allows local authorities to obtain a permit from all persons <br />using public property or public rights -of -way for the purpose of <br />constructing, operating, maintaining, offering or delivering any <br />emerging communications services. <br />• Allows a local authority to act pursuant to its own authority or <br />with other political subdivisions. <br />• Grants a local authority the right to collect reasonable permit <br />fees to recoup the costs of regulation including expenses <br />associated with monitoring of permit compliance, costs <br />associated with enforcement of PUC regulations and any <br />- 2 - <br />Page 43 <br />
