Hanson <br />City Administrator <br />515 Little Canada Road <br />Little Canada, Minnesota 55117 <br />Re: "At Will" Employment Provision <br />Our Pile No. 8132 <br />Dear Joel: <br />Telephone <br />(612) 2224641 <br />Facsimile <br />(612) 2238288 <br />If the City of Little Canada anticipates the establishment <br />of an "at will" employment with future department heads, I would <br />K recommend that a statement be signed by such employees, which <br />would contain language similar to the following: <br />"I understand and agree that my employment is at will' and <br />may be terminated without cause, without the need to <br />indicate a specific reason, and with or without notice, at <br />any time at the option of either myself or the City. <br />Neither the offer and acceptance of employment or the <br />establishment and maintenance of operating policies and <br />procedures by the City create a contract of employment with <br />me, other than that of an at will' employee. Nothing <br />contained in the Personnel Handbook shall be construed to <br />constitute a contract of employment, either express or <br />implied, nor shall anything in the Handbook be construed to <br />modify the 'at will' employment relationship." <br />As we have discussed, we would also recommend that we <br />review the provisions of the Handbook to add similar language to <br />exempt the "at will" employees and to remove any contradictory <br />provisions that would pertain to the "at will" employees. <br />Very truly yours, <br />sWEENHY, SORER & OSTROW <br />TMS/bab <br />Thomas M.
