only need to be located ten feet off the remaining <br />Jackson Street right -of -way. This area is now <br />considered a side yard setback as defined by zoning <br />ordinances. Even though the lot will abut on two <br />public right -of -ways, Jackson Street will have less <br />than 30 feet of right -of -way meaning it does not <br />qualify it as a street based on the definitions within <br />our zoning ordinance. Therefore, a ten foot side yard <br />setback would be allowed off the remaining portion of <br />the Jackson Street right -of -way not impacted by the <br />cul -de -sac placement. <br />* Purchase of approximately 322 square feet of right -of- <br />way from the Magnusons at a cost of $1,250. The cost <br />of this right -of -way acquisition will be fronted by the <br />City and held until such time as Australian is <br />reconstructed. At that time, it would be considered <br />part of the project costs for assessment purposes. <br />* Construction of an improved turn - around for Australian <br />Avenue that would make it at least equal to that <br />existing on Bluwood. The cost of this temporary cul- <br />de -sac would be borne by the City at this time and not <br />assessed until such time as the reconstruction of <br />Australian occurs. <br />* Placement of lot corners around the cul -de -sac to <br />designate revisions to each respective property. <br />As stated earlier, the property owners have given verbal approval <br />to this proposed solution.
