Code 301.030 and Zoning Code 918.060 <br />Joel, <br />Section 301.030 paragraph (A) of the Municipal Code should now be changed <br />with the adoption of the 1994 State Building Code to reference Chapter 1 of <br />the U.B.C. instead of chapter 3. <br />The portion of this paragraph that reads, "except that all plans for all new <br />structures, other than single family residential structures in a R -1 District, <br />shall be reviewed and approved by the City Council prior to issuance of the <br />permit." should be deleted. <br />This is not currently being done and I believe there are enough other <br />requirements in the City codes as far as platting, planned unit developments, <br />and commercial district requirements, which allow the Council input as far as <br />building construction. This section as it stands may create the situation where <br />the Council approves plans which do not comply with the Building Code. <br />In this paragraph there 1s a reference to Section 501.030. This section I believe <br />contains a "typo" in the first sentence that reads "construction with the City", <br />and should read "within ". <br />Paragraph (E) should be amended to include the requirement that the surveyor <br />stake the location of the budding and establish the grade elevations. <br />Zoning Code Section 918.060 paragraph C. is specific to the IP district. As <br />such, it may have been the intent to have the Council look at the building <br />plans however as it reads 11. creates the same problem as mentioned above, that <br />is the Council may approve plans which do not meet building code <br />requirements. It most certainly will cause delays in issuing building permits. <br />I would suggest that the portion of the sentence that reads "and building <br />plans" be deleted (note that the portion regarding plat approval may also be <br />redundant with other requirements of zoning and platting codes). <br />The other option would be to amend the wording from "building plans ", to <br />"building elevations ", however this aspect is already addressed by paragraphs <br />A,B,and D, of this section. <br />Page 18 <br />
