ENVIRONMENT & ENERGY RESOURCE CENTER <br />MUNICIPAL RETROFIT AGREEMENT <br />This AGREEMENT is between the City of Little Canade, Minnesota, a municipal corporation under the laws <br />of the State of Minnesota, herein after called "City" having its office at 515 Little Canada Road, Little Canada, <br />Minnesota 55369 and the ENVIRONMENT & ENERGY RESOURCE CENTER, a Minnesota non -profit <br />corporation, having its office at 427 St. Clair Avenue, Saint Paul, Minnesota 55102, hereinafter called <br />"EERC ". <br />WITNESSETH: <br />WHEREAS, Minnesota Statute §216B.241, Subdivision 2 as amended in 1991 as the Omnibus Energy Act <br />(the "Act "), requires an increased commitment to conservation and empowers the Commissioner of the <br />Department of Public Service (the "DPS ") to ensure compliance with the requirements mandated by the Act; <br />and <br />WHEREAS, Minnesota Rules 7690.1400 state that electric and gas utilities such as Northern States Power <br />Company (NSP) are required to file a Conservation Improvement Program (CIP) proposal with the DPS; and <br />WHEREAS, on June 11, 1993, the Commissioner of the Minnesota Department of Public Service (DPS) <br />approved the Local Government Energy Project (LGECP) within the NSP Conservation Improvement Program <br />(CIP). <br />WHEREAS, the City of little Canada shall convene an Energy Conservation Committee to include an NSP <br />representative, EERC LGECP manager, Little Canada LGECP Coordinator, and Little Canada departmental <br />staff (as affected); and <br />WHEREAS, the City is authorized under the Local Government Energy Project to assign by contract its <br />responsibilities for the development, implementation, operation and involvement of NSP CIP projects with <br />third parties, and; <br />WHEREAS, the EERC has the staff and expertise to engage in energy conservation service delivery. <br />Page 51 <br />
