Pursuant to my conversation with Dave Harris on April 28, <br />1995, I have added a provision to Section 2 which provides for an <br />administrative fee to reimburse the City for administrative costs. <br />It is my understanding that administrative costs of at least $50.00 <br />can be easily supported from past experience as a necessary fee to <br />reimburse the City for staff time and administrative costs associated <br />with the abatement procedure. In the event the City wishes to impose <br />a greater administrative fee in any case, staff time and costs <br />associated with that particular abatement would need to be <br />documented. Although the amount of the assessment for administrative <br />costs would appear reasonable, the assessment of administrative costs <br />could be subject to challenge. <br />The enclosed Ordinance includes a requirement that if the Notice <br />to Abate is served by mail, the notice be sent by certified and <br />regular mail. We do not believe that service by regular mail alone <br />would be sufficient to establish proper service. In particular, the <br />Statute governing abatement of nuisances requires that any mailed <br />notice be by certified mail. <br />It is my understanding that this ordinance will be on the City <br />Council agenda for consideration at the time of the next regularly <br />scheduled meeting on May 10, 1995.
