Fahey <br />COUNCIL <br />Beverly Scalze <br />Jim LaVaile <br />Steve Morelan <br />Bob Pedersen <br />ADMINISTRATOR <br />Joel R Hanson <br />Attached is a report prepared by the City Planner which discusses <br />planning and zoning issues within the B -3 Zoning District, <br />specifically the current language of the Zoning Code which allows <br />the carry -over of B -2 uses into the B -3 District. <br />Past Council discussions have centered upon the carry -over of <br />auto - related uses from the B -2 to the B -3 District. The <br />ordinance attached would eliminate the carry -over of all B -2 uses <br />which include much more than just auto - related uses. <br />Council should decide on the extent that it want to limit the <br />carry -over of uses. A public hearing should then be called to <br />consider amending the Zoning Code to the extent decided upon. As <br />you are aware, the development moratorium in the City's B -3 <br />Zoning Districts expires at the end of this month. <br />Since the earliest date that this public hearing could be held <br />would be at the June 27th Council meeting, it is staff's <br />recommendation that the development moratorium on all B -3 zoned <br />property outsid of TIF District 3 -1 be extended through the end <br />of June. (The moratorium on TIF District 3 -1 is in effect until <br />January of 1997 unless earlier repealled.) <br />As the Council is aware, some property owners affected by our <br />moratorium have asked that their properties be released to allow <br />them to proceed with development projects. Based on the <br />direction the Council provides at this meeting, project planning <br />for some parcels may be able to go forward. <br />Page 74 <br />
